Data protection – seralea®

SERAG-WIESSNER GmbH & Co. KG takes the protection of personal data very seriously. As a manufacturer of medical products, we pay particular attention to the protection of your data. We treat your personal data confidentially and will therefore process and use it in accordance with your consent and in accordance with the legal data protection provisions.

General information

This data protection information will give you an outline of what happens to your personal data when you visit our website. At the same time, we will inform you about what happens to your personal data when you contact us outside of our website. Various personal data are collected when you use our website or contact us otherwise. Personal data is data that can be used to identify you. This includes, for example, information such as name, address, telephone number or e-mail address. This data protection declaration explains which data is collected and what we use it for. It also explains why this is done.

We would like to point out that transmission of data via the Internet (e.g. when communicating by email) can have security gaps. An absolute protection of the data against access by third parties is not possible.

Principles for data collection at SERAG-WIESSNER GmbH & Co. KG

Who is responsible for data collection?

SERAG-WIESSNER GmbH & Co. KG, zum Kugelfang 8 – 12, in 95119 Naila, is responsible for the processing of your personal data within the meaning of the EU General Data Protection Regulation (GDPR) For all other questions on the subject of data protection, you can contact the address provided at any time.

How do we collect your data?

On the one hand, your data is collected when you communicate it to us, e.g. on the phone or by entering it in a contact form.
Other data is automatically recorded by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time of the page view). This data is collected automatically as soon as you enter our website.

What do we use your data for?

We collect, process and use personal data insofar as it is necessary for the establishment, content or change of the legal relationship (inventory data). Personal data about the use of our website (usage data) is recorded to the extent necessary to enable the user to use the service. The collection of data ensures an error-free provision of the website.

We use your personal data to process your (online) purchases from SERAG-WIESSNER GmbH & Co. KG and for sending delivery status notifications or notifications of problems with the delivery of your products. We use your personal data to process your payments. We also use your data to process complaints and product warranty claims. Your personal data will be used to verify your identity and to ensure that you have reached the minimum legal age required to make online purchases. Furthermore, we use your data for advertising purposes. This, among other things, allows us to inform you about new products, discount campaigns or similar.

Legal basis for the processing of your data

Insofar as we obtain the consent of the data subject for the processing of personal data, the GDPR serves as the legal basis for the processing of personal data.

How long will your data be stored?

Your data will be stored by SERAG-WIESSNER GmbH & Co. KG only for as long as is necessary for specific purposes. Your data will be deleted as soon as the corresponding legal basis for the processing of your data no longer applies, a legal obligation makes deletion necessary, you revoke your consent to the processing of your data or you have effectively objected to the processing of your data.
Legal retention periods remain unaffected.

Disclosure of your data to third parties

We only transmit personal data to third parties to the extent necessary for contract implementation (e.g. to transport service providers). Any further transmission of the data does not take place or takes place only if you have expressly consented to the transmission. Your data will not be disclosed to third parties, for example for advertising purposes, without your express consent.

What are you rights regarding your data?

Right to information

You have the right to receive information about the origin, recipient and purpose of your stored personal data free of charge at any time.

Right to correction and deletion

With regard to your data stored at SERAG-WIESSNER GmbH & Co. KG, you have the right to immediately have any incorrect data corrected and completed. Furthermore, you have the right to have your data deleted. To do so, the data must no longer be necessary for the processing purpose or, in the case of non-technical data, an effective revocation of your consent must be issued on your part. Likewise, the right also applies in case of your objection to the processing, an unlawful processing of your data, or if another obligation to deletion applies under national or European Union law.

Please note that your right to deletion does not apply in case of retention periods stipulated by law. Data required by us to assert, exercise or defend breaches of law are also exempt from your right to deletion.

Right to restriction

You have a right to demand a restriction of the processing of your personal data. You can do so at any time by contacting us at the address indicated in the legal notice. The right to restriction of processing exists in the following cases:

•    If you dispute the accuracy of your personal data stored by us – we usually need time to assess this. You have a right to demand a restriction of the processing of your personal data for the duration of the assessment.
•    If the processing of your personal data is/was unlawful, you can request a restriction of data processing instead of a deletion.
•    If we no longer require your personal data, but you need the data to exercise, defend or assert legal claims, you have the right to demand a restriction of the processing of your data instead of a deletion.
•    If you have lodged an objection in accordance with Art. 21 (1) GDPR, your interests and ours must be weighed up. As long as it has not yet been determined whose interests prevail, you have the right to demand a restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may only be processed – with the exception of their storage – with your consent or for the purpose of asserting, exercising or defending legal claims or protecting the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

Right to object

If the data is processed in accordance to Art. 6 para. 1(e of f) GDPR, you have the right at any time to object to the processing of your personal data for reasons that arise from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this data protection declaration. If you file an objection, we will no longer process your personal data concerned, unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims.
If your personal data is processed for direct advertising, you have the right to object at any time to the processing of your respective personal data for the purpose of such advertising; this also applies to profiling, insofar as it is associated with such direct advertising. If you object, your personal data will no longer be used for direct marketing purposes.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke a consent that you have already given at any time. To do so, an informal notification sent to us by email is sufficient. The legality of the data processing that took place up until the revocation remains unaffected by the revocation.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. Should you request the direct transfer the data to another responsible person, this shall only be carried out as far as is technically feasible.

Right of complaint

In the event of violations of the GDPR, those affected have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

SSL or TLS encryption

This site uses an SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the user of the site. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data that you transmit to us cannot be read by third parties.

Data collection – server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
•    browser type and browser version
•    operating system used
•    referrer URL
•    host name of the accessing computer
•    time of server request
•    IP address

This data is not merged with other data sources.
This data is collected on the basis of Art. 6 para. 1(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – the server log files must be recorded for this purpose.

If you send us enquiries via the contact form, your details from the enquiry form, including the provided contact details, will be stored by us for the purpose of processing the enquiry and in case of follow-up enquiries. We will not pass on this data without your consent.

The processing of the data entered in the contact form is therefore exclusively based on your consent. You can revoke this consent at any time. To do so, an informal notification sent to us by email is sufficient. The legality of the data processing that took place up until the revocation remains unaffected by the revocation.

The data you enter in the contact form will remain with us until you request its deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions – particularly retention periods – remain unaffected.

You can register on our website to use additional functionalities of the site. We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will refuse the registration.

We use the email address provided during registration to inform you about important changes, such as the scope of the offer or technically necessary changes.

Processing of data entered during registration is based on your consent. You can revoke your consent at any time. To do so, an informal notification sent to us by email is sufficient. The legality of the data processing that has already taken place remains unaffected by the revocation.

The data collected during registration will be stored by us as long as you are registered on our website and will then be deleted. Legal retention periods remain unaffected.
